CPR Institute is co-sponsoring an energy sector event with BakerHostetler titled "Protecting the International Project from Catastrophe," to be held on October 9th from 5:00 - 7:30 pm CT.

A panel discussion with energy industry leaders will be preceded by a networking reception.

The event will take place in BakerHostetler's Houston office.

Topics will include: 

  • Determining the most advantageous choice of law and forum for your project (avoiding common – and dangerous – misconceptions by choosing the “boilerplate” choice of law and forum)
  • The practical differences between the arbitration institutions (cost differences, time for the tribunal to decide, confidentiality, who wins if the arbitrators disagree on the outcome)
  • Sources of law to protect your client outside of the contract (e.g., relevant international treaties, lex mercatoria, etc.)
  • Asymmetrical warfare – creative strategies to position the client to win and collect (including best practices for asset recovery from the team that recovered the Madoff assets after his Ponzi scheme)
  • Classifying the Company’s products and services and obtaining relevant import/export authorizations
  • Screening all third parties and employees for sanctions compliance purposes
  • Reviewing potential investments and acquisitions for CFIUS-related concerns
  • Drafting appropriate contractual language to safeguard the Company
  • Ensuring proper internal compliance policies and procedures, including with respect to controlled items, foreign visitors and employees, and procurement
