CPR at Paris Arbitration Week
CPR Manager Kai Sass-Hauschildt joined an international panel of speakers during Paris Arbitration week: “Strategic considerations in deciding whether to challenge an arbitrator based on lack of independence: Perspectives from around the globe”.
Hosted by Davis Polk, in partnership with Paris Arbitration Week, Pinheiro Neto, Marval O’Farrell Mairal, and CPR, the panel drew on the experience of practitioners from around the world, and from an arbitral institution, to discuss how to deal with important questions of impartiality and independence, both on a practical and strategic level:
Where circumstances give rise to a doubt as to the ability of an arbitrator to be impartial and independent (before or after the constitution of the arbitral tribunal, before or after the issuance of the award), stakeholders face complex decisions as to whether to take action (objection, non-confirmation, challenge, resignation, replacement, annulment of the award)
