Panel 5: Implications of ESG (Environmental, Social, and Governance) in Dispute Management
ESG – referring to an enterprise’s best practices in environmental, social and corporate governance matters – has become one of the hottest topics in business over the last few years. ESG raises at least two important impacts on dispute management. First, well thought out ESG initiatives can mitigate a company’s reputational and legal risks, preventing conflicts. Second, we are seeing an increasing number of disputes based on ESG matters, including issues such as Business & Human Rights and Climate Change.
